Landlords, be confident in your occupation contract – speak to us today

A number of managing agents will be using Welsh Government's model contract when it comes to signing up contract-holders to new Occupation Contracts. We encourage you to ask your existing agent what changes, if any, they’re intending to make to the contract, as we strongly feel the terms Welsh Gov has included as standard put landlords in a weaker position than they should be in. 

At CPS Homes, our professionally-drafted, improved Occupation Contract will provide our managed landlord clients with an extra layer of much-needed protection. Here are just a few of the important changes we've made to the suggested terms and clauses:

  • Certain terms within the Welsh Gov's contract will leave landlords in a disadvantageous position when it comes to claiming for damages at the end of a tenancy. We've amended and improved these terms: learn more.
     
  • In our robust Occupation Contract, we’ve expanded and clarified the “unfit property” term to include the process that will need to be followed before a property is deemed unfit for human habitation, whilst still being fair to contract-holders: learn more.
     
  • Payments in the event of default are not included in the suggested model contract. Sometimes these are needed in order to save a landlord being out of pocket for an expense they’ve incurred due to an act or omission of the contract-holder.   • Welsh Gov’s model Occupation Contract doesn’t actually state the period for which rent payments relate to. Our enhanced Occupation Contract details exactly when each and every payment is to be made, and the period for which each one relates to, meaning there can be no doubt or dispute: learn more.
     
  • Welsh Gov’s contract doesn’t include an interest provision for late payment of rent, which would serve as a deterrent for contract-holders not intending to pay rent on time. Our clients can be assured that we’ve got a ‘late payment’ term included in our Occupation Contract, permitting the landlord to charge where payments are eight or more days overdue: learn more.
     
  • The concept of a "tenant-like manner" now ceases to exist. In our improved Occupation Contract, we’ve rectified this large omission by including a long list of tasks the contract-holder will be required to undertake as and when they arise, therefore recreating "tenant-like manner": learn more.
