Landlords warned to check the name on their RSW licence

Rent Smart WalesIt's common knowledge that self-managing landlords require a Rent Smart Wales (RSW) licence, but as one found out when he tried to evict his non-paying tenants recently, it’s incredibly important that the licence is in the same name as the ownership of the property.

After his tenants fell into serious rent arrears, Mr Jarvis served a section 8 notice in attempt to evict them. However, when the tenants discovered that his RSW licence was in his company’s name and the property was in his own name, they argued that the section 8 was invalid. The possession notice was overturned, and the tenants were able to remain in the property pending an appeal.

The case was reported by the Resident Landlords’ Association and serves as a reminder to landlords to ensure that the information within their registration and licences are accurate.

What do I need to do?

If an agent manages your property, you just need to register. If you use a tenant-find service and are responsible for the day-to-day management of the property, you will need to register and obtain a licence. More information can be found here.
