Let CPS Homes protect you against fixed-term to periodic contract pitfalls

Welsh Gov’s model ‘fixed-term written statement of occupation contract’ doesn’t make any reference to the fixed-term potentially becoming periodic later down the line, which exposes the landlord to big pitfalls if it does indeed become periodic:

  1. The landlord needs to give the contract-holder a new ‘periodic written statement of occupation contract’ within 14 days of the fixed-term ending. If they don’t, the contract-holder is able to claim back rent on a daily basis until it’s provided, up to 2 months’ rent.
  2. If the ‘periodic written statement of occupation contract’ is given late, i.e. after the 14-day deadline, the landlord can’t issue a possession notice for 6 months, starting with the date it is eventually given. That means at least one year from being able to begin possession proceedings in court, given the minimum notice period for possession is now 6 months.
  3. Any terms that may have amended when the 'fixed-term written statement of occupation contract' was issued will revert to the statue default when the contract becomes periodic.
